These provisions govern the use of the Internet portal service (hereinafter, the “Portal”) that PAYTEF SISTEMAS, S.L. (hereinafter, “PAYTEF”) makes available to Internet users.

Simple access, browsing, and use of the Portal attributes the condition of user (hereinafter, the “User”) and implies acceptance of the Legal Notice in force and published at all times on the Portal. The User must carefully read this Legal Notice each time they intend to use the Portal, as it and its terms of use contained herein may be modified.

Some Portal services accessible to Internet users or exclusive to PAYTEF clients may be subject to specific conditions, regulations, and instructions which, where applicable, replace, supplement, and/or modify this Legal Notice and which must be accepted by the User before the provision of the corresponding service begins.

The information contained in and accessible through this Portal is provided by PAYTEF to offer general guidelines and information of general interest to the user (the “Content”).

  1. Access and Use of the Portal

General access and browsing through the Portal do not require prior registration, except for those functionalities and/or services that do, in which case it will be necessary to provide certain information through the forms provided for this purpose.

The nature of the Portal’s content and the services provided through it are aimed at users over 18 years of age; therefore, access by users under that age is expressly prohibited.

The User undertakes to use the Content in accordance with the Law and this Legal Notice, as well as with any other conditions, regulations, and instructions that may be applicable. By way of example only, the User, in accordance with current legislation, must refrain from:

  3. c) Extracting and/or reusing all or a substantial part of the Content, as well as the databases that PAYTEF makes available to Users.

PAYTEF reserves the right to modify, suspend, cancel, or restrict the content of the Portal, the links, or the information obtained through it, without prior notice.

It is prohibited to transmit or send through the Portal any illegal or illicit content, computer viruses, or messages that, in general, affect or violate the rights of PAYTEF or third parties.

  1. Blogs

Blogs accessible through the Portal allow the publication of comments by the User, after providing their name and email address. In this regard, you are informed that your comments, along with the identifying data you provide, may be published on the Blog. The User undertakes not to publish any comment that may contravene this Legal Notice and will be exclusively responsible for the comments they publish, as well as their interactions with other users. Comments are in all cases subject to moderation, so PAYTEF reserves the right to deny publication or remove any comment or content that may violate the provisions of this Legal Notice.

  1. License over Communications

The User guarantees, with respect to any information sent to PAYTEF through any of the channels provided for this purpose (including instant messaging services, telephone calls, email, or others that may be made available to the User for such purposes), that they hold the required rights to do so, not infringing any industrial and/or intellectual property rights, patent, trademark, trade secret, or any other third-party rights.

The User assumes responsibility and shall indemnify PAYTEF with respect to any communication sent, personally or on their behalf, such responsibility extending without restriction to its accuracy, legality, originality, and ownership.

  1. Liability

Access to the Portal does not imply an obligation on the part of PAYTEF to verify the veracity, accuracy, adequacy, suitability, completeness, and timeliness of the Content provided through it.

In no event shall PAYTEF, nor its partners, directors, officers, agents, or employees be liable for direct, indirect, incidental, special, exemplary, punitive, consequential, or any other type of damages (including, but not limited to, liability for loss of use, data, or profits), regardless of the type of action, including but not limited to, contracts, negligence, or other civil torts arising out of or in connection with the Portal, the Content, or other content accessed through the Portal, as well as for the copying, display, or any other type of use thereof.

In no case shall PAYTEF, its administrators, employees, and authorized personnel be liable for any type of damage, loss, claim, or expense of any kind, whether or not arising from the use of the Portal, the Content acquired or accessed through it, computer viruses, operational failures, or interruptions in service or transmission, or line failures; the use of the Portal, whether by direct connection or by link or other means, constitutes a warning to any User that these possibilities may occur.

PAYTEF has adopted reasonable policies regarding the security of the Portal, although it assumes no responsibility for damages that may be caused to Users’ equipment by possible computer viruses contracted by the User due to their browsing on the Portal, or for any other damage derived from such browsing.

PAYTEF offers no guarantee regarding the continuity or absence of errors in any of the Content accessible through the Portal, nor does it guarantee the correction of any defect or the absence of viruses and other harmful components in this Portal or on the server that provides it.

Consequently, the services provided through the Portal may be suspended, canceled, or become inaccessible, prior to or simultaneously with the provision of the Portal service.

  1. Privacy Policy

The processing of personal data that may be carried out through the Portal will be governed by the provisions of the Privacy Policy, accessible at all times from the Portal, being an integral part of this Legal Notice.

The use of data storage and retrieval devices, also known as cookies or similar technologies, through the Portal will be governed by the provisions of the Cookie Policy, accessible at all times from the Portal, being an integral part of this Legal Notice.

  1. General Provisions and Precedence

The headings of the different clauses are for informational purposes only and will not affect, qualify, or extend the interpretation of the Legal Notice.

The non-exercise or non-enforcement by PAYTEF of any right or provision contained in this Legal Notice shall not constitute a waiver thereof, unless acknowledged and agreed to in writing by PAYTEF.

In case of any discrepancy between the provisions of this Legal Notice and the general and/or specific conditions of each specific service, the provisions of the latter shall prevail.

Should any provision of this Legal Notice be considered null or unenforceable, in whole or in part, by any competent Court, Tribunal, or administrative body, such nullity or unenforceability shall not affect the other provisions of the Legal Notice.

  1. Jurisdiction

The relationships established between PAYTEF and the User shall be governed by the provisions of current Spanish law. PAYTEF and the User, expressly waiving any other jurisdiction that may correspond to them, shall submit any controversies and/or disputes to the Courts and Tribunals of the city of Madrid.
