This Privacy Policy regulates the processing of personal data provided by the User through the Internet portal (hereinafter, the “Portal”) that PAYTEF SISTEMAS, S.L. (hereinafter, “PAYTEF”) makes available to Internet users. This Policy forms an integral part of the Legal Notice accessible at all times from the Portal.

The User guarantees that the data provided is true, accurate, complete, and up to date, being responsible for any direct or indirect damage or harm that may be caused as a result of the breach of such obligation. In the event that the data provided belongs to a third party, the User guarantees that they have informed said third party of the aspects contained in this document and obtained their authorization to provide their data to PAYTEF for the purposes indicated.

The Portal may offer features for sharing content through third-party applications, such as Facebook or Twitter. These applications may collect and process information related to the user’s browsing on different websites. Any personal information collected through these applications may be used by third-party users of the same, and their interactions are subject to the privacy policies of the companies providing the applications.

The Portal may host blogs, forums, and other social networking applications or services for the purpose of facilitating the exchange of knowledge and content. Any personal information provided by the user may be shared with other users of that service, over whom PAYTEF has no control.

In order to offer information or services of interest based on the User’s location, PAYTEF may access data relating to the geolocation of the User’s device, in those cases where the user’s configuration for this purpose so allows.

For the purposes of technical security and system diagnostics, in an anonymized or aggregated form, PAYTEF may record the IP address (the device’s Internet access identification number, which allows devices, systems, and servers to recognize and communicate with each other). This information may also be used for web performance analysis purposes.

2.1. For what purpose do we process the User’s personal data?

PAYTEF processes the information provided by the User in order to address various types of requests made by them. Depending on the nature of the request, the purpose will be the management of (i) inquiries and requests for proposals, sent through the contact form provided for this purpose, participation in blogs through comments, surveys, and electronic communications of an informative nature, according to their interests. PAYTEF may create a commercial profile based on the information provided. No automated decisions will be made based on said profile.

2.1.1. Information about data processing for sending communications from PAYTEF

The data used, or provided, in informative and/or promotional communications are processed by PAYTEF SISTEMAS, S.A. (hereinafter, “PAYTEF”) for purposes consisting of the electronic sending of information and communications about services, activities, publications, celebrations, greetings, and social and professional events of PAYTEF; the monitoring and optimization of marketing campaigns carried out using technologies for this purpose; and the creation of profiles for commercial purposes using contact details and their preferences.

The express consent granted by the data subject constitutes the legal basis for the aforementioned processing. In each of the communications received, you may unsubscribe from such mailings through the mechanism provided for this purpose. The data retention criterion will be based on your expression of opposition to the processing. In any case, the rights of access, rectification, objection, erasure, portability, and restriction of processing may be exercised, and any query regarding the processing of your personal data may be raised via email at soporte@paytef.es. To contact the Data Protection Officer, you may write to the email address soporte@paytef.es. Data subjects may also file a complaint, in case of dissatisfaction in the exercise of their rights, with the Spanish Data Protection Agency, through its electronic office using the electronic procedure for filing complaints.

2.2. How long will we keep the User’s personal data?

In general, the personal data provided will be kept for the time necessary to address the User’s request or as long as its deletion is not requested by the User.

2.3. What is the legal basis for processing the User’s personal data?

The legal basis for processing the data is the User’s consent.

2.4. To which recipients will the User’s personal data be communicated?

The data may be transferred to public administrations and bodies for the fulfillment of obligations directly enforceable on PAYTEF.

In those cases where the User accepts attendance at events organized or sponsored by PAYTEF in collaboration with other sponsoring, co-organizing, or service-providing entities, personal data may be provided to them, based on the legitimate interest of identifying the attendees of the event they organize or sponsor, as well as controlling access to the facilities where the event is held.

2.5 What are the User’s rights when they provide us with their personal data?

The User has the right to obtain confirmation as to whether PAYTEF is processing personal data concerning them, as well as to access their personal data, request the rectification of inaccurate data or, where appropriate, request its deletion when, among other reasons, the data is no longer necessary for the purposes for which it was collected.

In certain circumstances, the User may request the restriction of the processing of their data, in which case it will only be kept for the exercise or defense of claims.

In certain circumstances and for reasons related to their particular situation, the User may object to the processing of their data. PAYTEF will cease processing the data, except for compelling legitimate reasons, or the exercise or defense of possible claims.

The User may exercise the right to the portability of their data, in a structured, commonly used, and machine-readable format, and to transmit it to another data controller. Such action could involve a reasonable fee to be paid by the User, depending on the administrative costs incurred to satisfy the request, in accordance with the regulations.
